CasaBento is organising a Christmas Bento Photo Competition from 10/11/2012 au 20/12/2012, open and free to all participants without any obligation of purchase. Entry to this contest constitutes your acceptance to these rules.

Article 1 : Rules of Entry and Eligibility

To be eligible to enter the CasaBento Christmas Bento Photo Contest (the "Contest", an Entrant is open and free to all physical persons over the age of 18 years old (“Participant(s)” or “You”) without any obligation of purchase. Judges will choose the winning entries, and prizes will be awarded in accordance with these Official Rules (the “Rules”). 

HOW TO ENTER: To enter the Contest, each participant should submit two photos ("Entry") with these details: last name, first name, postal address, date of birth together with a description of the bento in the photo (ingredients, name of the bento box used ... ) to the following address: contest@casabento.com

CONTEST PERIOD: The Contest ends on December 20th, 2012 at 11:59:59 P.M. Paris Time. (“Contest Period”). All dates are subject to change. 

Article 2 : Contest Description

Each participant will use their own creativity to make a bento (decorative or free interpretation) according to the theme of Christmas and submit two photos of the bento. The bento creation will used to present the bento boxes sold by CasaBento.

As a condition of entry, the Participant grants CasaBento a perpetual, irrevocable, worldwide, transferable, royalty-free, and non-exclusive license to use, reproduce, adapt, modify, publish, distribute, publicly perform, create a derivative work from, and publicly display the Bento Photo for any purpose, including display on the CasaBento or CasaBento partners' websites, without any attribution or compensation to Entrant. Entries will not be returned.

Participants warrant that their Entries are their own original creations and, as such, they are the sole and exclusive owner and rights holder of the submitted Bento Photo and that they have the right to submit the Bento Photo in the Contest and grant all required licenses. Each Participant agrees not to submit any Bento Photos that: (a) infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, trade names, industrial designs, patent, trade secret, privacy, publicity or confidentiality obligations; or (b) otherwise violates applicable state, federal, or local law. 

Article 3 : Judging

The photos will be judged by :

- Susanne Kaluza (Norway)
- July des Bento de July (France)
- Shirley de Little Miss Onigiri (Singapore)
- Sarah de Bento und Mehr (Germany)
- CasaBento Girl's Team (Shake it up! Yeaaaaaaah ladies!)
- CasaBento Boy's Team (Say what? Roarrrrrr lions!)

Each Entry will be evaluated and scored based on the following:
(i) artistic merit - bento skills and use of color;
(ii) creativity and originality - considering the representation of the Contest theme “Christmas”, as well as the unique and novel approach to use of CasaBento products;
(iii) quality of photo submitted;
(iv) adherence to the the Contest Rules.

Using the above Criteria, there will be several levels to the judging process, which are discussed below. The judging will result in finalists for these following prizes: "First Prize", "Second Prize", "Third Prize", "Fourth Prize" and "Fifth Prize", as described in further detail below. 

Article 4 : Prizes

The prizes for this Contest are :
- First Prize: A Fukuro Round Bento Box, a Traditional Fukuro insulated bottle,  a pair of Fukuro chopsticks and a matching Fukuro Bento Bag.
- Second Prize: A Red Block Bento Box and a Concorde XL Black Thermal Bag.
- Third Prize: A Green Concorde Mini Box and a pair of Green Concorde Chopsticks.
- Fourth Prize: A Red Marche Thermal Bag, a Red Tokyo Mini Box and a Green Tokyo Mini Box.
- Fifth Prize: A Green Marche Thermal Bag, a Red Tokyo Mini Box and a Green Tokyo Mini Box.

Article 7 : Notification of Winners

The winner(s) will be selected and notified by email, at CasaBento’s discretion. If a winner does not respond to the notification attempt within five (5) days from the first notification attempt, then such potential finalist/winner may be disqualified and an alternate potential finalist/winner will be selected from among all eligible entries received based on the judging Criteria described herein. 

The prize will be sent by mail to the address indicated upon submission of the Entry. No transfer, substitution or cash equivalent for prizes is allowed, except at CasaBento’s sole discretion. Sponsor reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason. Value is subject to market conditions, which can fluctuate and any difference between actual market value and actual retail value will not be awarded. 

CasaBento reserves the right to publish the names of the Participaants with the Winners on the Contest Site or through other media for publicity purposes for up to two years.

By entering the Contest, Participants agree to participate in any media or promotional activity resulting from the Contest as reasonably requested by CasaBento at CasaBento's expense and consent to the use of their name and/or likeness by CasaBento. CasaBento will contact Participants in advance of any CasaBento-sponsored media request for interviews.


As a condition of entry, Participant grants CasaBento a perpetual, irrevocable, worldwide, transferable, royalty-free, and non-exclusive license to use, reproduce, adapt, modify, publish, distribute, publicly perform, create a derivative work from, and publicly display the Entry for any purpose, including display on the CasaBento  website, without any attribution or compensation to Participant. Entries will not be returned. Participant indemnifies and agrees to keep indemnified CasaBento at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the Entrant and/or a breach of any warranty set forth herein.

CasaBento is not responsible for any malfunction of the entire Contest Site or any late, lost, damaged, misdirected, incomplete, illegible, undeliverable, or destroyed Prizes due to postal delivery errors, failed, incomplete or address delivery malfunctions. All unclaimed Prizes that are returned after 30 calendar days will be considered rejected by the Contest Winner(s) and the Prizes will be reacquired by CasaBento. Participant agrees to defend, indemnify and hold harmless CasaBento from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys fees) arising out of or accruing from this Contest.

Article 5 : Binding Agreement

By participating in this Contest, you agree to the Rules. Therefore, please read these Rules prior to entry to ensure you understand and agree. You agree that submission of an entry in the Contest constitutes agreement to these Rules. You may not submit an entry to the Contest and are not eligible to receive the prizes described in these Rules unless you agree to these Rules. These Rules form a binding legal agreement between you and CasaBento with respect to the Contest. If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

Article 6 : Recourse to Judicial Procedures and Right to Cancel, Modfiy or Disqualify

If for any reason the Contest is not capable of running as planned due to any causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, CasaBento reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. 

Any attempt by any Participant to deliberately damage any web site, including the Contest Site, or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, CasaBento reserves the right to seek damages from any such Participant to the fullest extent of the applicable law. 

Any false information provided within the context of the Contest by Participant concerning identity, mailing address, telephone number, email address, ownership of right or non-compliance with these Rules or the like may result in the immediate elimination of the Participant from the Contest. 

The rights to litigate, seek injunctive relief or make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded, and Participants expressly waive any and all such rights. 

You may request a list of winners within 1 week of the announced results by sending a registered and self-addressed stamped envelope to CasaBento. No contestation of the results will be considered after one month of the Contest's closing date.

Article 7 : Assignment of Jurisdiction

These Rules shall be governed by, subject to, and construed in accordance with the French laws, excluding all conflict of law rules. By entering the Contest, you agree that exclusive jurisdiction for any dispute, claim, or demand related in any way to the Contest will be decided by binding arbitration. All disputes between you and CasaBento of whatsoever kind or nature arising out of these Rules, shall be submitted to the French Arbitration and Mediation department. The parties agree to share equally in the arbitration costs incurred. 

Article 8 : Information Technology Liberty Act 

The information collected in this draw are treated in accordance with the Information technology liberty Act of January 6, 1978, called "Informatique et Libertés". According to this Act, all contestants are allowed to access, modify or delete any information about them during and after the contest, by contacting CasaBento.

Article 9 : Literary and Artistic Intellectualy Property Rights

In accordance with the laws which govern the intellectual property rights in literary and artistic property, the reproduction, representation or exploitation of all or part of the elements making up the Website and the Contest shall be strictly prohibited.
As such this Site is protected by copyright, trademark, service mark and other proprietary rights and laws.

CasaBento hereby disclaims any liability or responsibility arising from the use of image rights and all conditions restriciting liberty on the use of photography. In the instance of non-compliance of law CasaBento will remove the image in question.
